In the following paper, I wish to examine a problem for the theist libertarian. On the one hand, libertarians insist that freedom requires possible alternatives open to the agent. On the other hand, God’s perfectly formed moral character implies that He always does the morally best. Give His moral character, then, it appears that there are no possible alternatives open to God. We thus get a dilemma for the theist libertarian: either a) God is not libertarian free – because His (...) moral character rules out possible alternatives; or b) God’s character is not perfectly formed – because libertarian freedom requires that it is possible for God to act out of character. In the present paper, I argue that Thomas Reid, a paradigmatic libertarian, has the theoretical tools to retain a robust account of libertarian freedom without compromising a robust account of perfectly formed characters. In sum, it is necessary that agents with fully formed characters always act in character (read de dicto), but it is possible that agents with fully formed characters act out of character (read de re). The former claim captures the robustness of perfectly formed moral characters and the latter claim captures the robustness of libertarian freedom. (shrink)

Call ‘a substance’ a person who is at home in a relatively stable and unified sense-making framework: a social structure that to some degree specifies which categories are important for interpreting reality, which goals are worth pursing, which character traits are admirable, etc. Call ‘an accident’ a person who is not at home in one such framework. It is tempting to think that being a substance is preferable, but I present some considerations for thinking otherwise. Mexican philosophers Emilio Uranga and (...) Jorge Portilla, I argue, present notions of accidentality as decolonial tools. Uranga’s account enables Mexicans to have positive valuation of their being independently of the approving gaze of the colonizers and their standards of value. Portilla’s thought distinguishes between pernicious accidentality resulting from the disintegration of sense-making frameworks and authentic accidentality as a condition for freedom, self-creation, and ultimately for individual and communal liberation. Jorge Portilla argues that authentic philosophical inquiry plays a liberating function. This function is that of bringing more fully to consciousness aspects of identities or ways of being‐in‐the world that have been, up until then, tacit or opaque to the agent herself to facilitate her endorsement, rejection, or modification of these identities. For Portilla, this function facilitates greater self‐mastery by increasing the range of free variations of subjectivity available to the agent, and this increase in self‐mastery itself constitutes a kind (...) of liberation. The main goal of this article is to provide a substantive interpretation of the nature of liberation Portilla thinks is embedded in this central function of authentic philosophical inquiry. I argue that this type of liberation should be understood ultimately in terms of increases in human agency, so I label it “agential liberation.” For Portilla, agential liberation involves two central elements: (i) a type of agential flourishing central to human flourishing, and (ii) an increase in the reach of intentional action that I describe as an expansion in the arena of human agency. Can a person from Latin America be a Catholic, or a feminist, or a democratic socialist in an authentic way? These identities come from Europe, and given the colonial history of Latin America, it seems reasonable to think that decolonizing the Latin American mind is a condition for its authenticity. Further, it seems reasonable to think that decolonization itself requires extirpating ideas and identities originating from the colonizers, especially those used to establish the colonial order. Thus, it seems that Latin (...) Americans cannot adopt such identities; authentic decolonization demands otherwise. In this paper I argue that the thought of twentieth century Mexican philosopher Jorge Portilla provides a persuasive account of the nature of authentic self-creation that allows for a kind of decolonization that makes it conceptually possible for Latin Americans to be Catholics, feminists, or democratic socialists in an authentic fashion. That is, authentic decolonization of the mind, I argue, need not involve a blanket rejection of identities originating from the colonizers; instead, it can be understood as a particular kind of authentic self-creation: one that is appropriately sensitive to the colonial history of the identities freely chosen by the agent. Leibniz claims that for every possible substance S there is an individual concept that includes predicates describing everything that will ever happen to S, if S existed. Many commentators have thought that this leads Leibniz to think that all properties are had essentially, and thus that it is not metaphysically possible for substances to be otherwise than the way their individual concept has them as being. I argue against this common way of reading Leibniz’s views on the metaphysics of modality. (...) I develop a model in which individual concepts are innocent; that is, individual concepts are divine ideas that permit God to know everything that will ever happen to all possible substances, if created, but these individual concepts neither require that all properties are had essentially nor require that it is metaphysically necessary for substances to be the way their individual concepts have them as being. Leibniz is commonly labeled a foe of Molinism. His rejection of robust libertarian freedom coupled with some explicit passages in which he distances himself from the doctrine of middle knowledge seem to justify this classification. In this paper, I argue that this standard view is not quite correct. I identify the two substantive tenets of Molinism. First, the connection between the conditions for free actions and these free actions is a contingent one: free actions follow contingently from their sufficient conditions. (...) Second, God knows what creatures would freely do in different possible circumstances prevolitionally—that is, prior to God willing anything. I argue that Leibniz himself endorses a version of both tenets and utilizes them for theoretical purposes similar to those of Molinists. I conclude that Leibniz is much closer to Molinism than is typically acknowledged. Leibniz is best characterized as a friend—rather than a foe—of Molinism. (shrink)

I argue for a novel interpretation of Leibniz’s conception of the kind of contingency that matters for freedom, which I label ‘agential contingency.’ In brief, an agent is free to the extent that she determines herself to do what she judges to be the best of several considered options that she could have brought about had she concluded that these options were best. Carlos Vaz Ferreira argues that the problem of freedom is conceptually distinct from the problem of causal determinism. The problem of freedom is ultimately a problem regarding the ontologically independent agency of a being, and the problem of determinism is a problem regarding explanations of events or acts in terms of the totality of their antecedent causal conditions. As Vaz Ferreira sees it, failing to keep these problems apart gives rise to merely apparent but unreal puzzles pertaining to the nature (...) of freedom and its relation to determinism. I argue for a substantive interpretation of Carlos Vaz Ferreira’s account of intellectual flourishing as intellectual liberation. For Vaz Ferreira, I argue, there is an inescapable master-slave dynamic between language and language users, so that flourishing intellectually essentially involves a type of mastery of language that frees up thinking from enslaving linguistic/conceptual confusions and thus facilitates the acquisition of truth. Central to this project are Vaz Ferreira’s most interesting, and radical, views on the nature of language signification and thus on (...) human’s ability to accurately describe and know reality, for failing to keep these linguistic limitations in mind, Vaz Ferreira argues, is a central way for language to enslave humans to confused thinking and thus prevent their intellectual flourishing. According to intellectualists, the will is a rational inclination towards apprehended goodness. This conception of the will makes its acts intelligible: they are explained by (i) the nature of the will as a rational inclination, and (ii) the judgement of the intellect that moves the will. From this it follows that it is impossible for an agent to will evil as such or for its own sake. In explaining wrongdoing intellectualists cite cognitive error or the disruptive influences of the passions; (...) these considerations, however, seem involuntary and at least partly exculpatory. The intellectualist needs an account that renders wrongful actions intelligible without undermining their status as responsible. I argue that Leibniz has the theoretical tools to provide at least part of an answer to this problem. In sum, an agent is directly responsible for her wrongdoing if the cognitive error or the disruptive influence of the passions that help explain this wrongdoing do not completely undermine her acting freely; an agent is indirectly responsible for her wrongdoing if she is directly responsible for previous actions which partly resulted in her wrongdoing, even if the presence of cognitive error or disruptive influence of the passions completely undermines her acting freely. Leibniz endorses several tenets regarding explanation: (1) causes provide contrastive explanations of their effects, (2) the past and the future can be read from the present, and (3) primitive force and derivative forces drive and explain changes in monadic states. I argue that, contrary to initial appearances, these tenets do not preclude an intelligible conception of contingency in Leibniz’s system. In brief, an agent is free to the extent that she determines herself to do that which she deliberately judges to (...) be the best from several considered options that she could have brought about, had she come to the deliberative conclusion that these options were best. I develop a model which illustrates how Leibnizian agents could have come to different deliberative conclusions, and which thus illustrates how Leibnizian agents could have acted differently. Se defiende que, aunque no de modo explícito, hay una afinidad entre ambas tesis y, en consecuencia, las debilidades de la segunda afectan a la primera. However, the point is to show how some emergent proposals, as the ecology of knowledges, could benefit from a full epistemological discussion, instead of insisting on its counter-epistemological nature. Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

The thesis that technology is applied science is called by Niiniluoto (1997) the standard view. That is surprising because the identification between technology and applied science has been widely rejected by both historians and philosophers of technology, including Rapp (1974), Bugliarello and Doner (1976), Derry and Williams (1977), Feibleman (1983), Skolimowski (1966), Vermaas et al., (2011), Don Idhe (2013). The reasons of such rejection mainly stem from the fact that technology has historically progressed without the benefit of science, i.e., it (...) has been possible to design technological devices without the explicit and systematic development of the scientific theories and laws that would explain their functioning. Polish philosopher Henryk Skolimowski has attacked this identification based on historical evidence. He argues that in the development of technology, there are many cases wherein technological designs have supported pure scientific research, rather than the other way round if technology were applied science. According to Skolimowski, some cases that dispute the identification of technology as applied science are the design of the transistor, supersonic aircraft, and the Manhattan Project. However, this historical evidence should not persuade us for two reasons: 1) Rejecting the previous scientific research that served as the basis for the said technological designs commits Skolimowski to anachronism. 2) From a realistic perspective of science, technological devices are not only subject to the principles and laws of science, regardless of the extent of our knowledge of them, but incorporate insights on more articulated explanations that while not available at the time of designing, do inspire our practical and theoretical efforts and guide further work. In this paper, we posit that the cases offered by Skolimowski to motivate his rejection of the standard view are far from being conclusive. To this end, we not only critically assess each case but also identify other historical examples that might be even more promising to support Skolimowski's thesis. Finally, we critically deal with those more promising cases and argue for a deflationary interpretation of the standard view. -/- . (shrink)

Este documento registra la entrevista al comunicador social Juan Manuel Rojas, gerente general de Creative Forward Films SAC (en el Perú), que ha realizado estudios orientados al tema audiovisual en la Universidad Inca Garcilaso de la Vega, la Universidad Católica Argentina y la Pontificia Universidad Católica del Perú. El propósito de esta conversación fue que se conociera de manera panorámica en qué consiste la formación de un comunicador y cómo esta es de utilidad para emprender un trabajo dirigido a (...) la práctica de lo audiovisual. Con las experiencias del entrevistado, se consigue construir una idea del universo cinematográfico en cuanto al desarrollo de los guiones y sus estructuras, el dominio especializado del lenguaje como herramienta fundamental y persuasiva para la publicidad, la crítica a las producciones de cine, los concursos que se promueven para respaldar la labor de los directores, etc. (shrink)

En este trabajo, se toma en cuenta el manuscrito de Gabriel García Márquez, Noticia de un secuestro (1996), el cual tiene una configuración narrativa muy peculiar. Su género os- cila entre la novela y la crónica periodística. Eso permite que se ausculten algunos rasgos inherentes en su composición, como el hecho de abordar temas sociológicos e históricos que comprenden el periodo finisecular del siglo XX en Colombia. Frente a ese contexto, lo que concierne en esta investigación es tratar lo (...) macrocriminal desde la perspectiva de lo transgresor, como el que se justifique desde lo ilegal cualquier acción por la ineficacia del mismo Gobierno. Este artículo realiza un análisis de los poemas de Luis Cernuda y Federico García Lorca que pertenecen a la generación del 27, un grupo de escritores españoles que surgió a inicios del siglo XX, que se distingue por la inmediata accesibilidad que suscitan para los lectores de su época, ya que adaptaron adecuadamente la poética del modernismo literario, que se opuso al determinismo y el estructuralismo estáticos del lenguaje como expresión. El propósito de este estudio es percibir las variantes, (...) producto de la contrastación de categorías, que se patentizan a partir de la extracción de los tópicos propios de los versos, para después corroborar con los paradigmas inmanentes del surrealismo, que están expuestos en los manifiestos de André Bretón, junto con la cosmovisión que adoptan Octavio Paz y Paul Illie. Resumen: Este artículo trata del método y su relación con la investigación educativa. El objetivo es analizar la relevancia del método en ciencias humanas y sociales, en especial, en educación. Para ello, dividimos este artículo en tres secciones: 1. ¿Hay método? 2. ¿Hay uno o varios métodos? 3. La discusión sobre el método en la investigación educativa. A la primera pregunta, respondemos que hay método. Respondemos a la segunda señalando la necesidad de adoptar un pluralismo metodológico. La tercera sección defiende (...) que las discusiones sobre el método de investigación educativa implican dimensiones ontológicas, epistemológicas y éticas que se han tornado críticas, y se hace una revisión de cada una de ellas. En el apartado conclusivo, sugerimos algunas vías para desanudar esos asuntos críticos en la investigación educativa.: This article deals with method and its relation to educational research. The objective is to analyze the relevance of method in human and social sciences, especially in education. To this end, we divide this article into three sections: 1. Is there a method? 2. Is there one or more methods? 3. The discussion on method in educational research. To the first question, we answer that there is a method. We answer the second question by pointing out the need to adopt methodological pluralism. The third section argues that discussions on the method of educational research involve ontological, epistemological, and ethical dimensions that have become critical, and a review is made of each of them. Este trabajo tiene la finalidad de fundamentar las razones que conducen al personaje Juan Pablo Castel de la novela de Ernesto Sabato El túnel (1948) a la psicosis, entendida esta como una estrategia involuntaria para interpretar la realidad y actuar en función de la cosmovisión que le genera. Para explicar esa adopción identitaria, retomo la taxonomía elaborada por Donald Shaw con respecto al contexto influyente del boom latinoamericano (que repercute negativamente en la psicología social) y la epistemología psicoanalítica de (...) Jacques Lacan al hacer referencia a nociones afines que configuran al protagonista como una entidad desligada del mundo real y que cuenta con un potencial saber infundado hacia la destrucción del ser. I argue that Bartolomé de las Casas and Juan Ginés de Sepúlveda differed in their conclusions regarding the status of Indigenous persons at least partly because las Casas had significant, yet incomplete, understanding of Indigenous persons, culture and societies and Sepúlveda had mere knowledge of them. To this end, I show that the epistemic state of understanding explains why Las Casas properly concluded that Indigenous persons deserve the same moral status afforded to Europeans. And I show how las Casas’ (...) understanding of Indigenous persons, culture and societies related to what he got wrong about Indigenous persons. (shrink)

Kant’s metaphilosophy has three main parts: (1) an essentialist project (“What is philosophy?”); (2) a methodological project (“How do we do philosophy?”); and (3) a taxonomic project (“What are the different parts of philosophy, and how are they related?”). This paper focuses on the third project. In particular, it explores one of the most intriguing yet puzzling aspects of Kant’s philosophy, viz. the relationship between what Kant calls ‘pure’ philosophy vs. ‘applied’, ‘empirical’ or what we can broadly refer to as (...) ‘impure’ philosophy. (As we shall see, in order to be able to address this third project, we shall also need to examine the other two projects in detail.) My plan is as follows. First, I discuss four main areas of pure vs. impure philosophy: (i) ‘pure logic’ vs. ‘applied logic’; (ii) ‘rational psychology’ vs. ‘empirical psychology’; (iii) ‘pure metaphysics of nature’ vs. ‘physics’ and (iv) ‘pure morality’ or a ‘metaphysics of morals’ vs. ‘moral anthropology’, ‘practical anthropology’ or ‘applied moral philosophy’. Based on this, I identify four key differences between pure and impure philosophy. Second, I critically examine four different readings of Kant’s views about the status of ‘impure’ philosophy: (a) that it is not genuine philosophy; (b) that it is bad or inferior philosophy; (c) that it is instrumentally valuable; and (d) that it constitutes an indispensable part of Kant’s philosophy, both in a theoretical and practical sense. I argue that Kant is best interpreted as endorsing readings (c) and (d). Third, I offer some concluding remarks. (shrink)

Noticia de un secuestro (1996), del Premio Nobel de Literatura Gabriel García Márquez, representa a la sociedad colombiana que atraviesa por un período caracterizado por el desarrollo de actos narcoterroristas, del cual se detecta el funcionamiento de Pablo Escobar —jefe del Cartel de Medellín— hacia el Gobierno. El presente artículo tiene como finalidad hallar aquellos referentes que permiten ubicar esta obra literaria en lo histórico y lo social —definidos desde la percepción del criminólogo Luis Rodríguez Manzanera al precisar sobre (...) la forma delictiva y la tensión provocada en la ciudadanía para denominarlas como macrocriminalidad—, junto con lo político-filosófico (el capitalismo definido desde el marxismo-leninismo) y lo literario —considerando el posboom como una manifestación artística que permite la incorporación de elementos propios de los Estudios Culturales; como, por ejemplo, la articulación de lo nacional y la crítica ideológica al sistema que los impera. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, (...) la extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

Este artículo fundamenta los factores que impiden que en Latinoamérica no sea notorio un desarrollo asequible de la creación de formulaciones teóricas. Uno de los grandes problemas se corrobora al detectar que sus postulados no son tan auténticos como sí los son en otros continentes. Y eso será debido a su estado de subordinación con respecto a estos países. Esa realidad los pone en una condición periférica, propia del “sur global”. Y lo que se busca es fluctuar propuestas antisistemas, socialistas (...) y localistas. Para demostrar esa realidad desde los ámbitos sociales y literarios, se realizó un análisis cultural con el soporte de textos interdisciplinarios, que dan constancia de la oscilación de la historia latinoamericana y sus fenómenos culturales. José Hugo Burel Guerra nació el 23 de marzo de 1951 en Montevideo (Uruguay). Desde 2017 es miembro de número de la Academia Nacional de Letras del Uruguay (ANL), institución a la cual ingresó con su discurso titulado «Ismael». Es licenciado en Letras por el Instituto de Filosofía, Ciencias y Letras (que se conoce en la actualidad como UCUDAL) y la Pontificia Universidad Católica de Río Grande do Sul. Aparte de ser escritor, se ha desempeñado como músico, publicista, diseñador gráfico, (...) profesor y periodista. Dentro del ámbito literario, ha publicado cuentos, novelas y ensayos. Entre su producción, algunos títulos son los siguientes: Esperando a la pianista y otros cuentos (1983), Tampoco la pena dura (1989), Los dados de Dios (1997) El autor de mis días (1999), El guerrero del crepúsculo (2001), Tijeras de plata (2003), Los inmortales (2004), El corredor nocturno (2005), El desfile salvaje (2007), El caso Bonapelch (2014) y La misteriosa muerte de Eleanor Rigby (2019). Asimismo, ha sido merecedor de múltiples distinciones. Algunas de ellas fueron el segundo premio del concurso literario de Radio Carve (1975), el Premio Juan Rulfo de Radio Francia Internacional (1995), el Premio de Inéditos del MEC-Ministerio de Educación y Cultura (1995), el VII Premio Lengua de Trapo de Narrativa (2001), el Premio Bartolomé Hidalgo (2004), el Premio Alas (2008) y el Premio Libro de Oro (2014). Noticia de un secuestro (1996) desarrolla una temática diferente a la obra literaria general de Gabriel García Marquez (quien de hecho la publicó en vida) debido a que representa un contexto propio de los Estudios Culturales. Para esta propuesta utilizaremos el método hermenéutico propuesto por Gadamer, el cual está basado en la mención de las investigaciones hechas hasta el momento por la crítica literaria junto con la sistematización que se hace de las mismas. Presentaremos en este artículo tres focalizaciones (...) que la crítica literaria ha desarrollado (entendiendo por esta el concepto de hermenéutica) sobre el texto ya aludido. La primera se basa en asumir que la novela sería una alegoría de Colombia; mientras que la segunda, la cuestionaría en tanto género literario, pues podría ser “novela periodística”, “novela histórica”, “novela documental”, etc. Finalmente, se expondrán las nociones teóricas y los métodos interpretativos que han usado los críticos para abordarla. El objetivo de este artículo es confrontar y promover el diálogo intertextual con los aportes manifestados para que se instaure un panorama hermenéutico sobre la base de la novela. (shrink)

Noticia de un secuestro (1996), novela periodística del Premio Nobel de Literatura Gabriel García Márquez, ha permitido que se realicen trabajos hermenéuticos en función de los Estudios Culturales, ya que su contenido abarca períodos históricos de Colombia, la Sociología, la Criminología y la política: todo ello vinculado con la prosa literaria del escritor. En esta oportunidad, lo que represento son tres vertientes de investigación que se han desarrollado sobre la base del estudio de esta obra, las cuales son la (...) manifestación intencionada de la violencia social en Colombia, la constitución del compromiso político-ciudadano y la fidelidad autoral por la exposición histórica en la misma novela. La finalidad de la confrontación y el diálogo intertextual con la crítica literaria es la de establecer un panorama hermenéutico con respecto a lo determinado en Noticia de un secuestro (1996). Tomando como referencia la novela periodística Noticia de un secuestro (1996) del Premio Nobel de Literatura de Colombia, Gabriel García Márquez, indago sobre el concepto de víctima, articulado por Olga Islas de González, con la intención de plantear la necesidad que requiere el texto sobre la búsqueda de un Estado nación, justificado en la práctica de la democracia, la libertad de expresión, el cumplimiento de las leyes y la Constitución: en oposición a lo expuesto en el período macrocriminal de (...) los últimos dos decenios del siglo XX en Colombia. Todo ello se muestra con el propósito de identificar el rol de los organismos encargados de contrarrestar las deficiencias de la sociedad colombiana, a través de la Policía (como el hecho de resguardar la seguridad ciudadana, que sería posible con una mayor investigación de su parte y una mejoría en el ámbito de la Criminalística). Asimismo, es de utilidad la extrapolación de las leyes (Decretos 2047/1990, 3030/1990 y 303/1991) que se establecen para aminorar el narcoterrorismo en ese país, sobre todo, para solicitar la extradición de los miembros del Cartel de Medellín a Estados Unidos, donde las sanciones para estos delitos relacionados era la pena de muerte. Para el desarrollo de este estudio, tomo en cuenta la novela periodística de Gabriel García Márquez, titulada Noticia de un secuestro (1996), la misma que sirve como referente para abordar una etapa crítica por la que atravesaba Colombia durante los dos últimos decenios del siglo XX. Este lapso se caracterizó por la presencia de corrupción gubernamental, el tráfico de drogas y la lucha armada. Ante esta situación social y política, se plantea como solución legal la incorporación de una política (...) criminológica, la cual es posible transferir en dos áreas específicas: las entidades del orden y los miembros de grupos narcoterroristas. En este proceso de menoscabar las deficiencias que provocan el Estado y sus opositores, los textos La arqueología del saber, Microfísica del poder y Vigilar y castigar de Michel Foucault son de utilidad por postular una nueva modalidad de afrontar la forma de sancionar a un reo, basada en la disciplina y proyectada hacia su reinserción eficaz en la sociedad. Concerns about threats to human autonomy feature prominently in the field of AI ethics. One aspect of this concern relates to the use of AI systems for problematically manipulative influence. In response to this, the European Union’s draft AI Act (AIA) includes a prohibition on AI systems deploying subliminal techniques that alter people’s behavior in ways that are reasonably likely to cause harm (Article 5(1)(a)). Critics have argued that the term ‘subliminal techniques’ is too narrow to capture the target cases (...) of AI-based manipulation. We propose a definition of ‘subliminal techniques’ that (a) is grounded on a plausible interpretation of the legal text; (b) addresses all or most of the underlying ethical concerns motivating the prohibition; (c) is defensible from a scientific and philosophical perspective; and (d) does not over-reach in ways that impose excessive administrative and regulatory burdens. The definition is meant to provide guidance for design teams seeking to pursue responsible and ethically aligned AI innovation. (shrink)

Para la construcción teórica que permitirá el análisis de Noticia de un secuestro (1996), me baso en el establecimiento del carácter sociológico que poseen las disciplinas de la Literatura y la Criminología (la manera de organizar la sociedad, mediante determinadas leyes y normas), además de poseer otras similitudes (dimensiones artística, interpretativa y escrita), tal como las señala Pérez (2006). El modo de articular estas propuestas resulta algo problemático, pues no hay un nexo interdisciplinario que esté total e intelectualmente elaborado, según (...) lo sostienen Nelson, Treichler y Grossberg: dificultad que no permitiría contextualizar, teorizar y cuestionar las bases con las que se trabajan. Por tal motivo, los Estudios Culturales tienen una funcionalidad necesaria: su metodología no cuenta con garantías sobre el privilegio que se les otorga a las estructuras internas de lo interdisciplinario. Para ello, he desarrollado dos orientaciones que explican ese fenómeno: los abordajes literario y criminológico. (shrink)

The article has two aims: (a) to show how the notion of self proposed by Zahavi allows to underlie different aspects of personal identity; (b) to provide some elements that strengthen and complement the arguments of the Danish philosopher. First, I begin with a phenomenological analysis of the acts. Second, I study the identity and the various levels of the self that underlie it. Finally, I present some elements to constitute a metaphysics of the human person as a complement to (...) Zahavi’s phenomenology, considering the philosophy of mind as a framework for reflection. This paper explores the idea of authenticity, both what it is and why it’s valuable. First, I identify and criticize three popular approaches to authenticity: Individual Authenticity, Natural Authenticity, and Truthful Authenticity. Second, I defend a fourth approach to authenticity – what I call Existential Authenticity (EA) – which is comprised of three basic elements: (a) self- understanding, (b) self-expression, and (c) self-concern – in particular, concern about what kind of person one is and what type of life one lead. I want to make sense of the view that singular causation involves a metaphysical necessary connection. By this I understand, where A and B are particulars, that ifA causes B then in every possible world in which A (or an A-indiscernible) or B (or a B-indiscernible) occurs, A (or an Aindiscernible) and B (or a B-indiscernible) occur. In the singularist approach that I will favour causal facts do not supervene on laws, causal relata are best understood as tropes, causation is (...) founded on the nature of its terms, and the necessity thus involved does not entail essentialism, determinism, and other usual problems. This paper proposes to reconstruct Boaventura de Sousa Santos' conception of "epistemologies of the south" both (a) as a critical theory aiming at denouncing the impoverishment of the epistemic field entailed by the normative imposition of a certain model of knowledge (what we call "the monoculture of reason"), and (b) as a long-term political project of a harmonic coexistence of different epistemologies ("an ecology of knowledges").

Una reseña mía sobre el clásico libro de Kojeve.

En este artículo analizamos la contribución de la teología protestante a la idea de autonomía moral a partir de un análisis de la obra de Juan Calvino. Mostramos cómo se afirma en ella la incapacidad del sujeto para conocer y querer el bien, manifiesto en la ley natural. Esta incapacidad es compensada con los mandatos bíblicos, para los que Calvino justificará una positivación jurídica en los Estados cristianos. Concluimos, por todo ello, que Calvino está lejos de la idea kantiana (...) de autonomía que consideramos distintiva de la Modernidad. (shrink)

La tesis central de este trabajo es que la tradicional tensión entre substancia y procedimiento socava las estabilidad de la justificación de la concepción liberal más extendida de la legitimidad (la Democracia Deliberativa). Dicha concepciones enfrentan problemas serios a la hora de articular de manera consistente dos dimensiones que parecen ir naturalmente asociadas a la idea de legitimidad: la dimensión procedimental, vinculada a la equidad del procedimiento, y la dimensión epistémica, asociada a la corrección de los resultados. En este trabajo (...) sostengo que a) esa tensión surge de la adopción de una concepción epistemológica social de tipo "veritativo-consecuencialista; b) es posible manejar dicha tensión mediante el remplazo de la epistemología subyacente por una concepción epistemológica social de tipo procedimentalista de orientación pragmatista y c) dicha operación orienta el diseño institucional en una dirección experimentalista. In line with recent efforts to empirically study the folk concept of weakness of will, we examine two issues in this paper: (1) How is weakness of will attribution [WWA] influenced by an agent’s violations of best judgment and/or resolution, and by the moral valence of the agent’s action? (2) Do any of these influences depend on the cognitive dispositions of the judging individual? We implemented a factorial 2x2x2 between–subjects design with judgment violation, resolution violation, and action valence as independent (...) variables, and measured participants’ cognitive dispositions using Frederick’s Cognitive Reflection Test [CRT]. We conclude that intuitive and reflective individuals have two different concepts of weakness of will. The study supports this claim by showing that: a) the WWA of intuitive subjects is influenced by the action’s (and probably also the commitment’s) moral valence, while the WWA of reflective subjects is not; b) judgment violation plays a small role in the WWA of intuitive subjects, while reflective subjects treat resolution violation as the only relevant trait. Data were collected among students at two different universities. All subjects (N=710) answered the CRT. A three-way ANOVA was first conducted on the whole sample and then on the intuitive and reflective groups separately. This study suggests that differences in cognitive dispositions can significantly impact the folk understanding of philosophical concepts, and thus suggests that analysis of folk concepts should take cognitive dispositions into account. El artículo trata de dar respuesta a tres cuestiones, que agrupan algunas de las objeciones que pueden plantearse a la democracia como sistema político: a) la incapacidad popular para el autogobierno, b) la corrupción y la formación de élites gobernantes yc) el peligro de tiranía de las mayorías. El desarrollo de estas objeciones es el hilo argumental alrededor del cual se desarrollan algunos de los retos pendientes y rasgos más propiamente distintivos de una democracia consolidada.

Two of the most important ideas in the philosophy of law are the “Coase Theorem” and the “Prisoner’s Dilemma.” In this paper, the authors explore the relation between these two influential models through a creative thought-experiment. Specifically, the paper presents a pure Coasean version of the Prisoner’s Dilemma, one in which property rights are well-defined and transactions costs are zero (i.e. the prisoners are allowed to openly communicate and bargain with each other), in order to test the truth value of (...) the Coase Theorem. In addition, the paper explores what effect (a) uncertainty, (b) exponential discounting, (c) and elasticity have on the behavior of the prisoners in the Coasean version of the dilemma. Lastly, the paper considers the role of the prosecutor (and third-parties generally) in the Prisoner’s Dilemma and closes with some parting thoughts about the complexity of the dilemma. The authors then conclude by identifying the conditions under which the Prisoner’s Dilemma refutes the Coase Theorem. (shrink)

Среди выдающихся латиноамериканских философов, которые так или иначе занимаются аксиологическими nроблемами, находится месиканец Эдуардo Гарсия Майнез. По мнению Майнеза, каnитальные проблемы аксиологии могут быть сведены к четырем: а) проблема существования ценности; б) nроблема оценочного nознания; в) проблема реализации ценности; д) проблема свободы выбора личностью ценности. В данной работе анализируется в основном те идеи этого автора, которые касаются nервой из этих больших nроблем - вопроса о существовании ценностей. Entre los más destacados filósofos mexicanos que trabajan la problemática axiológica se encuentra el (...) mexicano Eduardo García Maynez. En opinión de Maynez los problemas capitales de la axiología son cuatro: a) el problema de la existencia del valor; b) el problema del conocimiento valorativo; c) el problema de la realización del valor; d) el problema de la libertad del hombre en la elección del valor. En este trabajo se analiza, en los fundamental, las ideas de este autor referidas al primero de estos grandes problemas: el tema de la existencia de los valores. (shrink)

In “Semantics of Fictional Terms,” Garcia-Carpintero critically surveys the most recent literature on the topic of fictional names. One of his targets is realism about fictional discourse. Realists about fictional discourse believe that: (a) it contains true sentences that have fictional names as their subjects; (b) sentences containing names can be true only if those names have referents; (c) fictional names have fictional characters – abstract objects – as their referents. The fundamental problem that arises for realists is that not (...) all true sentences containing fictional names are plausibly about abstract objects. This leads to the need to introduce disjunctive conceptions of property attribution that Garcia-Carpintero claims are implausible, and that realism should therefore be rejected. He also maintains, however, that (a) is correct. I agree. Furthermore, I am also committed to anti-realism about fictional discourse – that fictional names have no referents. Garcia-Carpintero claims that my view is simply a notational variant of realism. I argue that this is false – that my view could not possibly be a notational variant of any extant realist theory. This is the original English version of the introduction to Ciencia, Realidad y Racionalidad (University of Cauca Press, 2015), which is a collection of my essays translated into Spanish by Juan Carlos Aguirre Garcia.

Prior to this intervention the site used to be a degraded fiscal property, that functioned as a bus yard, a police legal deposit, and a restaurant parking lot. Underneath it runs the Maldonado stream culvert, covered by a concrete slab at a depth of only -20cm. Next to the site is a 5m high railroad embankment. The plot is strategically located at the end of Juan B. Justo avenue and works as a gateway to the Tres de Febrero park (...) (also known as Bosques de Palermo, the Buenos Aires’s biggest green space designed by Charles Thays in 1875). It is situated in the neighborhood of Palermo, an area that underwent a vertiginous residential and commercial expansion since the late 90´s. -/- The design approach is influenced by the adjacent urban fragments: the grounds of the Sociedad Rural Argentina, the surrounding Avenues Santa Fe-Sarmiento; the opening of Darregueyra street expected for the near future, the implementation of historic preservation guidelines for the Tres de Febrero Park, and the proposal for the development of nearby railroad yards. -/- Specifically, the project seeks to minimize the impact of the fast traffic that runs along Bullrich avenue, improving pedestrian and cycle access to the park. At the same time it defines new landscape features, utilizing the earth made available by the tunneling works of a new subway line. -/- The project comprises the structuring of an existing 800 meter long embankment and the transformation of the sidewalk into a public promenade. This is achieved through a wider sidewalk of 12m on average, which is part of a series of longitudinal stripes ranging from high speed to quiet spaces. The first band of grass and aged tipas (tipuana tipu) buffer pedestrian and cyclist from automotive traffic. Cycle traffic is organized on its own lane. The sidewalk itself contains several bays that act as urban lounges. Next, a continuous concrete bench delimits the beginning of the slope, backed by a stripe of grass that works as a soft extension. Finally, plants for contemplation are arranged as undulating traces. Rhythmic use of retaining gabions defines longitudinal segments of varying slope, unifying the spacial criterion. This series is punctuated by an amphitheater and framed by triangular plazas at the corners. -/- Material choices for hard surfaces are constrained by concerns of durability, low cost, and consistency with other ongoing public works. -/- Hard materials, as well as the plant selection needed to be low-maintenance. The palette was kept to reinforced concrete, granitic slabs, and granite stone in large size –forming retaining gabions- and as loose finishing for pavements. Likewise, the lack of a protective enclosure and of continuous surveillance dictated that urban furniture and fixtures be anti-vandalic. The stealing of these components –from inspection lids, to benches, to plants- is a common problem in urban spaces in many Latin American cities. To prevent this, fixtures must be designed according to precise specifications regarding their weight, fixing and anchoring systems, and mechanical parts. -/- Sidewalks are organized through a 6 meter grid made of granitic white slab, infilled with textured combed nonslip concrete modules. Extended bays and corner squares are finished with white and black slabs respectively. These materials are similar to another used in public spaces under construction, in the believe that it creates a collective identification of themselves along the city. -/- The continuous reinforced concrete bench is 1.10 m wide, in order to allow people to use it in non-conventional ways. Further up on the slope, undulating paths separate plant species and provide access for gardening, but are also open to use by the public. They are paved with 2 meter-long precast concrete slabs (smaller and lighter pieces were avoided to deter robbery). As they reach the gabions they connect with sloping paths covered with loose granitic stones. The gabions themselves allow the creation of varying slopes while contributing to retaining the soil, which is reinforced with geosynthetic fabric in the perimeter to avoid landslides originated by strong rains typical of the region. -/- Urban furniture is featured on the wider bays of the sidewalk and at corner plazas. It includes seats, water fountains, bicycle racks, wastepaper baskets. As a counterpoint to the linear concrete bench, groups of concrete seats are arranged informally. These seats are a reinterpretation of the dynamic BKF chair (also known as Butterfly chair), the classic Argentinean design of the 1930’ by Antonio Bonet, Juan Kurchan, and Jorge Ferrari-Hardoy. A few low concrete tables complete these spaces as authentic urban lounges. Lighting design accompanies the general features of the project and creates a new scenography emphasizing night-time usage. -/- Landscape gardening criteria is set up by a selection of various species of high-resistant pasture (grass). The higher the slope, the higher the grass, increasing the final volumetric result. Based on considering the original tipas line (tipuana tipu, a species from the north of Argentina, yellow flowering) as a vertical wall that frames the view, the horizontal stripes contain a single species each, differing in size, shade and flowering periods –adding, in the middle band, a changing color on the big green plane slope in the same chromatic range. The final configuration of the stripe sequence from bottom to top: bermuda grass, bulbine frutescens, euryops pectinatus. The upper band existing native species is reinforced with new samples: paspalum exaltatum + cortadera selloana and ipomea + thumbergia climbing the railway fence. Each sector between gabions has an automated system of drip irrigation. Near the corner plazas, several palms are planted to provide shade and identity to the street-crossing. -/- The intervention proposes an ambivalent effect on the landscape, trascending the merely ornamental by accompanying the motorist in speed, while conforting the pedestrian with spaces for contemplation and urban relax.
